These Terms of Service govern your use of the Atlas Defense Solutions LLC website and your purchase of products or services from Atlas Defense Solutions. By accessing this website, submitting a quote request, or completing a purchase, you agree to these Terms.
1. Eligibility & Lawful Use
Customers are responsible for ensuring that any product purchased from Atlas Defense Solutions may be lawfully purchased, possessed, transported, transferred, exported, used, or received in the customer’s jurisdiction.
By purchasing from Atlas Defense Solutions, you represent that you are legally permitted to acquire the products ordered and that the products will be used only for lawful purposes.
Atlas Defense Solutions reserves the right to refuse or cancel any order when required by law, regulation, manufacturer restriction, export-control requirement, suspected fraud, or other compliance concern.
2. Product Information
Atlas Defense Solutions makes reasonable efforts to provide accurate product descriptions, specifications, images, pricing, and availability. Manufacturers may modify specifications or products without notice.
Customers are responsible for confirming compatibility, configuration, sizing, specifications, and suitability before purchase.
3. Pricing, Quotes & Orders
Prices and availability are subject to change without notice.
Agency, government, commercial, bulk, RFP/RFQ, and special-order quotations may be subject to separate pricing, expiration dates, lead times, manufacturer requirements, and written terms.
Submission of an order does not constitute acceptance by Atlas Defense Solutions. We reserve the right to review, verify, accept, decline, or cancel an order before fulfillment.
4. Payment & Taxes
Customers are responsible for all applicable taxes, fees, duties, shipping charges, and other costs associated with an order unless otherwise stated in writing.
Tax-exempt organizations must provide valid supporting documentation when required.
5. Shipping & Delivery
Delivery dates and lead times are estimates unless expressly guaranteed in writing.
Atlas Defense Solutions is not responsible for delays caused by manufacturers, distributors, carriers, weather, government actions, supply-chain disruptions, or circumstances outside our reasonable control.
Customers are responsible for providing complete and accurate delivery information.
6. Returns, Refunds & Cancellations
All sales are subject to the Atlas Defense Solutions Refund & Return Policy.
Unless otherwise required by applicable law or expressly approved by Atlas Defense Solutions in writing, all sales are final.
Special-order, custom-configured, agency-specific, bulk, serialized, restricted, or manufacturer-direct products may not be canceled once processing has begun.
7. Export Controls — ITAR & EAR
Certain products, components, software, technology, technical data, and services offered or referenced by Atlas Defense Solutions may be subject to U.S. export-control laws and regulations, including the International Traffic in Arms Regulations (ITAR), 22 CFR Parts 120–130, administered by the U.S. Department of State, Directorate of Defense Trade Controls (DDTC), and/or the Export Administration Regulations (EAR), 15 CFR Parts 730–774, administered by the U.S. Department of Commerce, Bureau of Industry and Security (BIS).
Products subject to export controls may not be exported, reexported, transferred, released, disclosed, or otherwise provided to foreign persons, foreign destinations, restricted end users, or prohibited end uses without any authorization required by applicable U.S. law.
Customers agree that they will not:
- Export, reexport, transfer, divert, or release controlled products or technical data contrary to U.S. law.
- Provide controlled products or information to prohibited or restricted persons, entities, destinations, or end users.
- Use products in connection with unlawful, prohibited, or unauthorized activities.
- Circumvent U.S. export-control, sanctions, licensing, or end-use restrictions.
The purchaser is responsible for determining and complying with all laws and authorization requirements applicable to its transaction and intended use.
No international shipment, export, reexport, or transfer should be assumed authorized merely because a product is displayed or available for purchase through this website.
Atlas Defense Solutions may request documentation regarding citizenship, organization, end user, end use, destination, government affiliation, or other compliance information before processing an order.
8. Government & Agency Procurement
Agency and government customers may submit requirements, RFPs, RFQs, solicitations, specifications, and procurement documentation to Atlas Defense Solutions.
Unless expressly incorporated into a written agreement accepted by Atlas Defense Solutions, submission of procurement documents does not modify these Terms.
9. Manufacturer Warranties
Products may be covered by warranties provided by their respective manufacturers.
Except where Atlas Defense Solutions expressly provides a separate written warranty, manufacturer warranty claims are governed by the applicable manufacturer’s warranty terms.
10. Intellectual Property
All Atlas Defense Solutions branding, logos, original graphics, website content, photographs, text, and other proprietary materials may not be copied, reproduced, distributed, or commercially used without authorization.
Third-party trademarks and manufacturer logos remain the property of their respective owners.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Atlas Defense Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, possession, installation, use, misuse, inability to use, or performance of products purchased through this website.
12. Indemnification
To the extent permitted by law, customers agree to indemnify and hold Atlas Defense Solutions harmless from claims, losses, liabilities, or expenses resulting from unlawful use, unauthorized transfer, misuse, export-control violations, or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
14. Changes to These Terms
Atlas Defense Solutions may update these Terms periodically. Changes become effective when posted to this website.
